A judge in Virginia has ruled in favour of a motion from the SEC in a case brought by Empower Oversight, but with some exceptions. The judge said government agencies must conduct a "reasonable search for responsive records" in FOIA requests, and that the SEC's searches were not "reasonably calculated to uncover all relevant documents" in some of Empower's requests.
The documents requested by Empower relate to communications between Marc Berger, Jay Clayton and William Hinman while they were at the SEC. The SEC claimed it had complied with Empower's FOIA requests, but the judge ruled that both parties must provide a status update on 19 July.
