The banker stated that he hopes to protect stakeholders from the SEC's appeal of the summary judgment ruling.

Ripple has opposed the investment banker's statement from the same law firm that supports the SEC, causing concerns for the defendant. Meanwhile, Ripple's Chief Legal Officer Stuart Alderoty stated that the SEC is only seeking permission from the court to appeal, not appealing the decision that XRP is a security.
