The trader sold 62 CryptoPunk NFTs in 2021, making a profit of about $7.4 million, and then sold 35 CryptoPunk NFTs in 2022, making a profit of $4.9 million. However, Waylon Wilcox submitted a false 2021 tax year personal income tax return in April 2022, underreporting about $8.5 million in income tax and about $2.1 million in tax owed; and then submitted a false 2022 fiscal year personal income tax return in October 2023, underreporting about $4.6 million in income tax and nearly $1.1 million in tax owed. Under federal law, the maximum penalty for these crimes is a total of six years imprisonment, followed by a period of supervised release and fines.
